The CVA includes a look-back provision that temporarily grants adult survivors the right to bring a claim—no matter when the abuse occurred. Due to the COVID-19 pandemic, the Child Victims Act look-back period has been extended until August 14th, 2021.
  2. The Law Extends the Statute of Limitations: After August 14, 2021, the Child Victims Act extends the statute of limitations for child sex abuse claims in New York. The law increases the amount of time in which a civil lawsuit can be filed. The civil statute of limitations now runs until the victim’s 55th birthday. No one should be denied their right to bring a claim simply because of an unreasonably harsh legal deadline.
  3. The Law Covers Abusers and Institutions: The Child Victims Act applies to businesses, private organizations, and public entities. In far too many cases, child sex abuse occurred because of the negligence of a trusted institution. Victims can file a civil lawsuit against public or private entities that protected abusers or looked the other way.
