Workers who lift heavy objects or repeatedly lift objects face a high risk of suffering a painful back injury known as a “herniated disc.” But anyone can suffer a back injury that includes a herniated disc. If you injured your back at work or because of someone else’s negligence in New York, you may be entitled to compensation.

Using your back muscles instead of your leg and thigh muscles to lift large, heavy objects can lead to a herniated disc, as can twisting and turning while lifting, according to the Mayo Clinic. Other traumatic events, such as a fall or a blow to the back, can also cause a herniated disc.

Back problems such as herniated discs are one of the leading causes of disability for people in their working years, according to the Occupational Safety and Health Administration (OSHA). They affect over 600,000 employees each year.

If you suffered a herniated disc as a result of an on-the-job accident or an accident caused by someone else’s negligence, the law firm of Powers & Santola, LLP, can help. Our experienced personal injury attorneys can evaluate your legal claim in a no-obligation, free initial consultation.

Herniated Discs:
More Than Back Pain

Disc herniation is damage to one or more of the rubbery cushions (discs) between the individual bones (vertebrae) that make up the spine.

An injured and bulging disc – sometimes called a “slipped” or “ruptured” disc – can irritate nearby nerves. This often causes pain, numbness or weakness in an arm or leg. A herniated disc that does not press on a nerve may cause an ache in the lower back. A slipped disc can also cause severe deep-muscle pain and muscle spasms.

A herniated disc in the lower (lumbar) back may lead to sciatica. Sciatica is pain that travels through the buttocks and down a leg to the ankle or foot. Pressure on the sciatic nerve causes the pain. Low-back pain may accompany the leg pain.

In the upper part of the lumbar spine (near the bottom of the rib cage), a herniated disc can cause pain in the front of the thigh. A slipped disc in the neck may cause pain or numbness in the shoulders, arms and chest.

In rare cases, disc herniation can compress the entire cauda equina, which is a group of long nerve roots just below the waist. Cauda equina syndrome often requires emergency surgery to relieve pressure and avoid permanent paralysis, impaired bladder and bowel control, loss of sexual sensation and other problems. Even with immediate treatment, some patients do not recover complete function.

We Pursue Compensation for People with Herniated Disc Injuries

If you have suffered a herniated disc in an on-the-job accident or through the cumulative effect of your job duties, you may qualify for New York workers’ compensation benefits. If you have suffered a slipped disc in an accident caused by someone else’s negligence, you may be eligible for compensation to assist with your medical bills, lost income and other losses.

Unfortunately, employers often challenge legitimate workers’ comp claims, and insurers of negligent parties are reluctant to pay what an injured victim deserves. An attorney from Powers & Santola is ready to help you get the money you are entitled to.

We can help you make sure your herniated disc is properly diagnosed and demonstrated in medical records in order to satisfy a personal injury claim.
